Your attention is drawn to the following conditions of sale and entry into the Singapore Turf Club (the “Club”).
1. INTERPRETATION
(a) The headings in these Conditions are inserted for convenience only and shall not affect the interpretation of these Conditions.
(b) Unless the context otherwise requires, words importing the singular shall include the plural and vice versa and words importing a specific gender shall include the other genders (male, female or neuter).
(c) Any reference to conduct includes without limitation, an omission, statement or undertaking, whether or not in writing.
(d) “Club” means Singapore Turf Club
(e) “Patron” refers either to (1) a person entering the Singapore Turf Club with a Ticket allowing such entry on the date/time specified on said Ticket, for the specific purpose for which the Ticket was purchased; or (2) a person entering the Singapore Turf Club pursuant to an Invitation allowing such entry on the date/time (and to the locations within the Club) specified on said Invitation.
(f) “race” or “races” means a horse race or all of the horse races scheduled to be run on the date specified for a particular Ticket
(g) “Ticket” means a pass or certificate, which may be issued by the Club in physical and/or electronic form, that may be purchased from the Club to give the holder the right to enter the Club for the purposes and on the specific date/time specified at the point of purchase of said Ticket. For the avoidance of doubt, the issuance and sale of a Ticket may be carried out directly by the Club or through its authorised ticketing agent, whichever is applicable at that point in time.
(h) “Invitation” means an invite by the Club or a member extended to a person in order to give the said person the right to enter the Club on the specific date/time (and to the locations within the Club) specified. For avoidance of any doubt, Invitations are extended by the Club and/or member ex-gratia, without consideration in return. As such, the Club bears no contractual obligation or liability to the invited person.
2. GENERAL CONDITIONS
Any Ticket purchased (whether by the Patron or by another authorised person in compliance with these Conditions), and the Patron’s entry to and presence at the Singapore Turf Club are all subject to these Conditions and any accompanying risks, obligations and responsibilities. Similarly, while a Patron with an Invitation has not purchased a ticket, he or she will be deemed to have accepted these Conditions and any accompanying risks, obligations and responsibilities upon using and presenting said Invitation to gain entry into the Club. These Conditions are available at the website www.turfclub.com.sg or at appointed sales points.
By purchasing and/or using and presenting a Ticket/Invitation to gain entry into the Club, the Patron is deemed to have accepted and agreed to be bound by these Conditions. It is the Patron’s responsibility to ensure he has read and understood these Conditions and any accompanying risks, obligations, and responsibilities.
2.1 Prohibition against Ticket on-selling and unauthorised Tickets/Invitations
2.1.1 Tickets/Invitations may not be resold or transferred, or attempted to be resold or transferred (in each case, whether for free or otherwise, or in any form or manner, or whether as a package with accommodation, transportation, food, beverage and/or other ancillary item or experience in the course of business or otherwise; and shall not be purchased or obtained from or through any commercial agent or company or otherwise than directly from the Singapore Turf Club (or its appointed authorised agent), without the prior written consent of the Singapore Turf Club, whose consent, if given, may be subject to any conditions it sees fit to attach thereto. The Club shall be entitled to reverse any Ticket sale transaction howsoever made, at any time prior to or at the point of Ticket collection and/or delivery, without providing reasons. The Club shall also be entitled to withdraw any Invitation extended, at any time prior to or at the point of collection and/or delivery, without providing reasons.
2.1.2 Any Tickets/Invitations obtained in breach of these Conditions shall be void and all rights conferred or evidenced by such Tickets/Invitations shall be nullified. Any person seeking to use a Ticket/Invitation obtained from sources not authorised by the Club or its appointed authorised agents or obtained in breach of these Conditions in order to gain or provide entry to or remain at the races will be liable to be refused admission to or be rejected from the venue where the races are to be held and may be liable to legal action. The Club reserves the right to retain, confiscate or void (in the absolute discretion of the Club) any Ticket/Invitation held by any Patron reasonably determined by the Club to be in breach of these Conditions without any liability to make any refund in respect thereof.
2.1.3 Tickets/Invitations shall not be used for advertising, promotional or commercial purposes (including, without limitation, trade incentives, prizes, competitions, contests, sweepstakes, raffles, tombolas, lotteries, or draws, whether for commercial or charitable purposes) without the prior written consent of the Club, who may withhold such consent at their sole and absolute discretion.
2.2 Seating and viewing arrangements
2.2.1 Any authorised impression or map of the Club is provided as a guide only to the approximate locations of seating, viewing areas, and facilities in the Club and around the Grandstand and may not be drawn to scale. The Club reserves the right to determine actual and final location of the details concerning seating, viewing areas and other facilities without notice. The Patron acknowledges and accepts that no reliance is placed on such impression or map of the Club when purchasing Tickets or using an Invitation or upon entry to the Club and no booking of seats will be allowed at the public grandstand.
2.2.2 In the event of inclement weather on the day of the races, the Club shall have the sole and absolute discretion to delay or postpone the races or any one race or more for that day, and if necessary, to cancel or abandon the races. The races may resume after such delay or postponement.
2.3 Refunds
2.3.1 Invitations are ex-gratia and therefore refunds or replacements are not applicable under any circumstances. Except as expressly provided in this Clause 2.3 or any other clause in these Conditions expressly providing for refunds, a Ticket cannot be exchanged or refunded under any circumstances (including, but not be limited to, any adverse weather conditions or any circumstances beyond the reasonable control of the Club).
2.3.2 The Club will refund the cost of a Ticket to the Patron of that Ticket (subject to such Ticket having been paid in full) only ifthe entire race day is cancelled and cannot be re-scheduled.;
2.3.3 The Club is not obliged to replace a Ticket/Invitation under any circumstances, including but not limited to, loss or theft of the Ticket/Invitation.
3. SECURITY
3.1 The Patron shall comply with:
(a) any security arrangements, directions or notices displayed or given by the Police or officers, employees or agents of the Club, including without limitation, notices, directions or other requirements relating to access and security in the Club;
(b) these Conditions of Sale attaching to the races and the conditions of entry; and
(c) all laws, regulations or requirements of the Police or any authorities (including, without limitation, the Club’s Constitution) having jurisdiction over the activities of the Club, the races and/or the use or occupancy of the Club and its Facility.
3.2 For reasons of safety and security, the Club reserves the right in its discretion:
(a) to refuse suitcases, bags and/or other objects being brought into the Club (or into any area in the Club) whether before, during or after the race;
(b) to inspect any bag or other item which any person wishes to bring in to or remove from the Club, whether before, during or after the races; and
(c) to search any Patron at the Club for prohibited items pursuant to Clause 8.
3.3 Without prejudice to Clause 3.1, while at the Club, the Patron must maintain safe, prudent, and respectful behaviour and comply with all security measures and instructions given by any official.
4. TICKETS: ACCESS, ENTRY, DISPLAY & PRICING
4.1 The Patron is only permitted access to the areas (as designated) of the Grandstand in the Club and shall not enter any of the facilities or restricted areas designated by the Club.
4.2 Anyone below the age of eighteen (18) will not be admitted into the Club’s Grandstand during a race day. For the avoidance of doubt, all persons regardless of age must have a valid Ticket to enter the Club during a race day.
4.3 Tickets/Invitations are non-transferable on the day or during the day of presentation. Within the Club premises, the Patron must display his Ticket/Invitation upon request at any time by the Club’s employees, agents or by the Police. No person will be admitted into the Club without a Ticket/Invitation.
4.4 The Club reserves the right to refuse to admit or to eject from the Club any person who does not comply with Clauses 4.1 to 4.3 above.
4.5 Risks and Warnings
4.5.1 The conditions at the race may vary, including access, seating, and protection from weather, terrain and facilities available. As some areas of the Club are exposed to weather, Patrons are advised to take appropriate care and have appropriate protection from adverse weather conditions as necessary.
4.5.2 As a condition of entry into the Club, the Patron acknowledges and accepts that horse races and the activities associated therewith are dangerous and attending the races or being in or in the vicinity of the Club may involve personal risk, and that attendance at the races or the Club is entirely at the Patron’s own risk. Patrons are reminded of and agree to, accept and acknowledge the warnings, indemnities and limitation of liabilities set out in Clause 7 below.
4.5.3 While at the Club, Patrons must always keep to the designated zones and take reasonable care while using steps / escalators.
4.5.4 The Club may, subject to applicable laws, designate one or more areas within the Club as a smoking area. Smoking is not permitted anywhere in the Grandstand and outside of the designated smoking area.
4.6 Purchase of admission into the Club
Admission tickets for Grandstand Level 1 are available for purchase via direct deduction of EZ-Link or NETS FlashPay card, or through cash payment via self-service ticketing kiosks located at the Club. Tickets to Trophy Lounge at Grandstand Level 3 are also available for onsite purchase.
4.6.1 The use of multiple identities to circumvent these Conditions, or any applicable laws and regulations is strictly prohibited. You or any user of the Premises (being any part of the Singapore Turf Club buildings and grounds) found to be in breach of these Conditions and/or found to have circumvented, abused and/or wilfully disregarded these Conditions to purchase or make bookings may be prohibited from making any future purchase of the admission Ticket and/or entry into the Club.
4.6.2 Compliance with prevailing Vaccination-Differentiated Safe Management Measures (“VDS”) shall be a pre-condition of entry into the Singapore Turf Club. As the authorities may issue changes to Covid Safety measures at any time, any of the VDS in effect at the time of ticket purchase may change at short or no notice, whether in relation to entry requirements or continued attendance within the Singapore Turf Club. Patrons who fail to meet these updated VDS requirements prevailing on the date of the races/event in question will be denied entry into the Singapore Turf Club.
4.7 Patrons in possession of any Tickets/Invitations must not sell, offer or make available for sale any Tickets/Invitations to the races.
4.8 The Club may, in its discretion, refuse to accept Ticket orders and/or cancel Ticket orders from anyone it believes plans to offer Ticket(s) for resale.
4.9 Patrons are to keep their Tickets/Invitations safe and in good condition as a duplicate Ticket/Invitation may not be reissued if it is lost or stolen (save as provided in Clause 2.3.3) and a defaced or illegible Ticket/Invitation may become invalid.
4.10 The Club shall be entitled to suspend or cancel any ticket transaction on the suspicion of use of a fraudulent or unauthorised credit card, or where in its full discretion the Club suspects it is the subject of a suspected illegal transaction for any other reason, in which event, the Club shall not be liable for any loss or damage whatsoever arising therefrom.
4.11 The Club reserves the right to refuse admission to or eject from the Club any Patron:
(a) whose presence within the Club is, or could (in the Club’s reasonable opinion), constitute a source of danger, nuisance or annoyance to any other person; and/or
(b) where (in the Club’s reasonable opinion) circumstances relating to health and safety, environmental and/or security concerns require such refusal or ejection;
(c) who participates in any form of illegal betting / bookmaking activities and sales of prohibited items/substances/products inside the Club premises. The Club will have the right to remove the Patron and the latter would be served with a Prohibition Notice and excluded from future entry to the Club and all Singapore Pools Private Limited (SPPL) live betting venues for a period of not less than 6 months. Where required, the Patron may also be referred to the relevant authorities for necessary onward action.”
5. ALTERATIONS TO EVENTS
5.1 The schedule for the races (whether published or otherwise) and its proposed format are only provisional and are subject to change if necessary due to adverse weather conditions or other reasons. The Club is not liable to Patrons for any changes in the races, or any other element of the races or arising from the arrangement of substitute races.
5.2 The Club reserves the right to change races line-up, the Club’s facilities and placement and accessibility of screens / TV / Monitors and wagering counters or facilities.
6. PHOTOGRAPHS, IMAGES & RECORDING, AND THE COLLECTION OF INFORMATION
6.1 Patrons must not make, create, store, record or transmit any kind of sound recording, visual footage or audio-visual footage of, at or in relation to the races (“Recording”), or store, record or transmit any information or other data, including official timing, results, performance, telemetry, weather or racecourse data of, at, or in relation to the races (“Data”). Unless authorised by the Club in writing, Patrons must not bring into or use within the Club any equipment that may enable a person to do the aforementioned acts. Personal electronic devices (including still image cameras and mobile telephones) are permitted within the Club unless otherwise advised, provided that any Recording, Data and any image, including photographic images and any still pictures derived or capable of being derived from a Recording of, at or in relation to the races (“Image”) that is recorded, stored and/or created thereon is used for personal, private and non-commercial purposes only (which does not include use in social media).
6.2 Without limiting any action available to the Club, it is a condition of sale and/or entry into the Club that all Patrons acknowledge and accept that it is a condition of entry to the Club that:
(a) the use of any such Recording, Data or Image (“Footage”) or any part of it for profit, commercial gain, public advertisement, display or for any other purpose except for the private enjoyment of the person making / recording the Footage, without the prior written consent of the Club is strictly forbidden and will constitute a breach of these Conditions for which the Patron may be liable; and
(b) if a person makes or reproduces or uses such footage or any part of it with or without the consent of the Club, that person shall on request by the Club, assign in writing, all copyright and all intellectual property in the footage to the Club or its assignees.
6.3 All Patrons shall acknowledge and agrees that the Club or appointed third parties authorised by the Club may make or record film or other forms of moving pictures, still pictures, sound recording or any of them of the race (including, without limitation, of Patrons) (collectively called “Recordings”). Unless the Patron otherwise reaches an agreement with the Club, Patrons hereby grant the Club and third parties authorised by the Club permission to use photographs, film, tape, or other images or likenesses of the Patrons, or any sound recording, in any media (including publication within and outside Singapore) and for any purpose without identification, compensation or payment of any kind. Patrons shall acknowledge that:
(i) the venues / locations at which the races are held are locations which are open to the public and/or are locations which would be the subject of the Recordings;
(ii) areas accessible to Patrons are locations which are open to the public and/or are locations which would also be the subject of the Recordings,
(iii) the Recordings referred to constitutes reasonable expected means by which personal data may be recorded at such locations and in connection with the race; and
(iv) as the entry to the races and associated events are entered or accessible via the purchase or procurement or receipt of a Ticket/Invitation, the races and associated events are deemed “publicly available” events for the purposes of the Personal Data Protection Act 2012. The handling or processing, or publication, posting, display, streaming or broadcast, of any moving pictures, still pictures, sound recording or any of them will be otherwise subject to such policies relating to personal data as the Club may apply, in each case as may be made publicly available at its website at www.turfclub.com.sg or such later versions or additional supplements as may be published by the Club from time to time.
6.4 Patron’s consent to being photographed, filmed and recorded as members of the races’ audience, and consent to the use of any such film, image or recording for public transmission.
6.5 The Club shall have the right to allow any authorised photographers and / or videographers into the Club for photography and/or video recordings for future advertising and promotional purposes without prior permission from Patrons.
7. INDEMNITY AND LIABILITY
7.1 These Conditions constitute the entire agreement between the Club and Patrons and supersede any previous agreement or understanding and may not be varied except as expressly agreed in writing by an authorised officer of the Club. All other terms, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law. Where any conflict arises between the terms contained in the booking form and these Conditions, the latter shall prevail.
7.2 The Club has limited control over the actual running of the races (Live or simulcast) and all details and descriptions in relation thereto are for guidance purposes only. For the avoidance of doubt, the date for the races is subject to change by the Club. In the event of the date change, Patrons will be admitted with the existing Ticket/Invitation in hand.
Patrons acknowledge that the race may be held on any such dates as approved and confirmed by the Club. If Tickets are purchased prior to the dates of the races being confirmed by the Club, then the Patrons acknowledge and agree that the provisional dates of the race may change and that the Patrons will not be entitled to a refund in such circumstances. If the published provisional dates are changed, such changes will either be notified directly to the Patron or published at the website www.turfclub.com.sg and the Patron’s existing Ticket will be valid for the re-scheduled dates. Patrons with Invitations have no right of refund where there are date changes. The Club may, at their discretion, permit previously-extended Invitations to be used at the re-scheduled dates.
7.3 The Club shall not be held liable for any act or omission by any person not employed directly by the Club. The Club shall have no liability for the acts or omissions of any of their respective servants, agents or employees.
7.4 Patrons acknowledge and accept that horse racing, the races and certain activities associated therewith (including without limitation, support horse races) are dangerous and accidents can happen and that there is a possibility of an accident-causing injury, death, property damage or loss, and accordingly, Patrons attending the races do so at their own risk. Patrons acknowledge the risks associated with attending or participating in the raceday include but are not limited to the risk of suffering harm to their persons or property as a result.
7.5 Save for death or personal injury to a Patron caused by the negligence of the Club, the Club shall not be liable to the Patrons by reason of any acts or omissions of the Club (or its employees, agents or contractors), any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of these Conditions for any loss of profit or any indirect, special or consequential loss, or any damage, injury, costs, expenses or other claims (whether caused by the negligence of the Club (or its employees, agents or contractors)) or otherwise which arise out of or in connection with the provision of the races (including any delay in providing or failure to provide the races). In any event, the entire liability of the Club under or in connection with these Conditions shall not exceed the price of the Ticket(s) save for liability arising from death or personal injury caused by the negligence of the Club. For Patrons with Invitations, the entire liability of the Club under or in connection with these Conditions shall not exceed a sum equivalent to the price of a Ticket(s) purchased to the same race/event, save for liability arising from death or personal injury caused by the negligence of the Club.
7.6 Save for death or personal injury to a Patron caused by the negligence of the Singapore Totalisator Board and Singapore Pools Pte Ltd (“Associated Entities”), the Associated Entities shall not be liable to the Patron by reason of any acts or omissions of the Associated Entities (or their respective employees, agents or contractors, or the Club), any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of these Conditions for any loss of profit or any indirect, special or consequential loss, or any damage, injury, costs, expenses or other claims (whether caused by the negligence of the Associated Entities (or their respective employees, agents or contractors, or the Club)) or otherwise which arise out of or in connection with the races.
7.7 Patrons further acknowledge and agree that the Club and the Associated Entities do not make any warranty that the attendees at the races will be provided with due care and skill or that any materials provided in connection with the Club will be fit for the purposes for which they are supplied. Patrons acknowledge that, to the extent that any warranty is implied, it is excluded to the fullest extent permitted by law.
7.8 The Club shall have no liability for any loss, damage or expense caused by cancellation of the races because of government action, strike, civil commotion, war, national disaster, pandemic (including measures taken by the government or relevant authority in response thereto) or other force majeure event.
7.9 The Club shall have no responsibility for any property or personal effects brought in and/or left behind at the race by the Patron.
7.10 The Club gives no warranty (whether expressed or implied under statute or otherwise) that the races shall take place at the time and place stipulated or at all and all conditions (whether expressed or implied, whether under statute or otherwise) in respect thereof are excluded. Save as provided in Clause 2.3, the Club shall not be liable to give any refund to the Patrons if the races are delayed, postponed or cancelled.
8. PROHIBITED ITEMS
8.1 Without prejudice to Clause 3 and Clause 6.1, and in addition thereto, for the comfort and safety of patrons and players, the following items are NOT allowed into the Club:
Alcohol, pets or animals, any item that could be used as a weapon, audio recorders, video cameras, bicycles, scooters, skateboards and roller-blades/skates, cans, chairs/stools, coolers and hampers, fireworks and sparklers, Frisbees, helium balloons, glass (including bottles), food and drink (except for 1 clear plastic bottle of soft drink or mineral water of no more than 600ml), large flags (except for national and team flags), musical instruments and/or amplification equipment, unauthorised advertising material or flyers, laser pointers, distress signals, whistles or loud hailers, remote controlled crafts and drones, and any item prohibited by legislation. The items listed in this Clause 8.1 are not exhaustive and a list of all prohibited items will be placed at the entrance to the Club and/or areas designated by the Club.
8.2 For the avoidance of doubt, Patrons shall not bring food or beverages of any description into the Club.
9. DEFAULT
9.1 The Club reserves the right, with reasonable cause, to refuse entry to any person or remove any person from the Club and/or races. In particular, any person who does not comply with these Conditions may be refused entry or removed from the Club and/or races.
9.2 If any Patrons are found to commit or attempts to commit any breach of these Conditions, then, on the giving of notice by the Club to the Patron at any time after the occurrence of such breach:
(a) the Patron shall be deemed to have forfeited its rights but not its obligations under these Conditions;
(b) The Club will be free to cancel, re-sell, confiscate and/or void (in the absolute discretion as instructed by the Club) any Ticket(s)/Invitation(s) held by the Patron who is in default; and
10. MISCELLANEOUS
10.1 The Club may at any time in its sole discretion amend or vary any provision of these Conditions by publication at the website www.turfclub.com.sg, and the Patron shall be subject to and bound by the version of these Conditions in effect at the material time where a right or obligation arises thereunder. If
10.2 Each of the provisions of these Conditions is severable from the other(s). If any such provision or part thereof is or becomes invalid, unenforceable or illegal in any respect, such provision or part thereof shall, to the extent that such term is invalid, be deemed not to form part of these Conditions but the validity, enforceability or legality of the remaining provisions hereunder shall not in any way be affected or impaired thereby.
10.3 The Contract (Rights of Third Parties) Act (Cap. 53B) shall not under any circumstances apply to this Agreement and any person who is not a party to this Agreement shall have no right whatsoever to enforce this Agreement or any of its terms.
10.4 These Conditions are governed by the laws of Singapore and the parties hereby submit to the non-exclusive jurisdiction of the courts in Singapore.
10.5 Without prejudice to Clause 6.3, the collection, use or disclosure or handling of personal data by the Club shall be subject to such policies relating to personal data as the Club may apply, in each case as may be made publicly available at its website or such later versions or additional supplements as may be published.
