TERMS AND CONDITIONS FOR PHOTOGRAPHY COMPETITION
SINGAPORE TURF CLUB: CAPTURING OUR BEAUTY IS ORGANISED BY SINGAPORE TURF CLUB (“THE CLUB”)
ACCEPTANCE OF TERMS & CONDITIONS
1. By submitting an entry to the skill-based photography competition titled “Singapore Turf Club: Capturing Our Beauty” (the “Competition”), you acknowledge that you have read, understood and agreed to be bound by these Terms & Conditions.
2. Please go through the following Terms & Conditions that govern the relationship between YOU and THE CLUB which include information on how to enter the Competition, how the winners will be determined, the prizes, and how personal data will be collected, retained, used and shared.
PERMITTED PARTICIPANTS
3. The Competition is open to all individuals residing in Singapore and who are at least 18 years of age (as at 4 April 2024). Employees of THE CLUB and any related companies, sponsors and/or advertising agencies, as well as their immediate family members, may not enter the Competition.
4. Intended participants under the age of 18 must obtain the written consent of a parent or legal guardian before participating in the photo competition and shall submit proof of such consent, if required by THE CLUB. This consent shall imply that the parent or legal guardian agrees to the Terms & Conditions set out herein and will ensure that their child or ward will comply with the Terms & Conditions herein.
5. A “Participant” refers to an individual who satisfies the above criteria and submits a Qualifying Entry (as defined below) within the Competition Period (as defined below).
ENTRY TO THE COMPETITION
6. The Competition is open for entry from 18:00 hours (Singapore Time) on 4 April 2024 and closes by 23:59 hours (Singapore Time) on 30 August 2024 (“Competition Period”). Any entry submitted outside the Competition Period shall be void.
7. To participate, a Participant is required to:
a. submit their entry by uploading the photograph image (the “Image”) to the Competition website: turfclub.com.sg/photo- competition (“Website”); and
b. truthfully and accurately fill in all necessary fields indicated on the Website, during the Competition Period. As a condition of entering the Competition, YOU must provide all information requested or otherwise required by THE CLUB. In the event that YOU fail to supply information required by THE CLUB, THE CLUB reserves the right to treat your entry as invalid.
8. Participants are allowed to submit a maximum of three (3) entries during the Competition Period. However, each Participant is eligible to win only one (1) prize out of the total five (5) prizes available.
9. Participants acknowledge and agree that to be eligible for the Competition, the Image must comply with the following requirements:
a. each Image must be an original photograph captured by the Participant. Any artwork and/or graphic illustrations will not be accepted;
b. the Image must be wholly the original work of the Participant, and shall not infringe the intellectual property rights of any third party;
c. the Image must not have previously won or been submitted for any professional awards/prizes and/or been used previously for any commercial purposes or in any marketing and advertising campaigns;
d. the Image submitted for the Competition may not be submitted for any future commercial purposes or any future professional awards or prizes; and
e. no digital manipulation of the Image is permitted except for colour correction and filters.
10. Any Image that does not comply with the above requirements will be invalidated and disqualified.
11. Any Image contains imagery that is disrespectful obscene, scandalous and/or vulgar will be invalidated and disqualified.
12. No fee or purchase is necessary to enter the Competition.
13. A “Qualifying Entry” refers to the successful submission by a Participant of a completed entry that complies with the above requirements and criteria, together with any other information requested or required. The determination of whether any entry is complete and valid shall be solely at THE CLUB's discretion.
WINNERS AND PRIZES
14. At the close of the Competition Period, every Qualifying Entry will be judged on their storytelling, composition, creativity and relevance to the theme of the Competition (as described in paragraph 1). Each Qualifying Entry will be assessed on its own merits. Chance plays no part in determining the winners.
15. Participants whose entries have been shortlisted will be notified by email and may be asked to submit the original or a high-resolution version for printing purposes.
16. The top five (5) entries will be selected as the “Winners” by a panel of judges (“Judges”) appointed and authorised by THE CLUB, based on the creative merits of the submitted Image. The decision of the Judges is final and unappealable. No correspondence pertaining to the selection process and decision will be entertained.
17. The Winners will receive the following cash prize:

18. The Winners will be notified individually by email by the end of September 2024.
19. The Winners will be required to acknowledge receipt of the email and provide THE CLUB with such information as may be requested (including but not limited to full name and residential address of the Winners) within five (5) days of such notification failing which his/her Prize will be forfeited automatically and THE CLUB shall be free to deal any unclaimed Prize in any manner as it sees fit.
20. Each Winner must, if required by THE CLUB, show proof of eligibility for receipt of the Cash Prize. If requested by THE CLUB, Winners may be required to sign a separate prize claim form in order to redeem his/her Prize. Should a Winner be unable to collect their Prize personally, they must provide a signed letter authorising a proxy to collect on their behalf, in a format specified by THE CLUB. Winners and authorised proxies are required to provide the appropriate identification documents for verification when collecting the Prize.
21. The Winners agree that upon confirmation of receipt of the Prize, THE CLUB shall be permitted to display each Winner’s name and their winning entry on THE CLUB’s website, owned social media pages and physical showcase at Singapore Turf Club for such time and in such manner as THE CLUB deems fit and appropriate.
THE CLUB’S DECISIONS
22. THE CLUB’s decisions as to any matter relating to the Competition, including but not limited to any entry eligibility, the winning entry(ies) and the Winner(s), will be final and binding. No correspondence will be entertained about the Competition or THE CLUB’s decisions.
PUBLICITY AND COPYRIGHT
23. By participating in the Competition, the Participants and the Winners:
a. agree to the use of their name and/or likeness, without compensation, by THE CLUB and/or any party authorised by THE CLUB;
b. grant THE CLUB and any party authorised by THE CLUB an irrevocable, worldwide, perpetual, royalty-free right and licence to use the Images and any material submitted as a part of their entry into the Competition, and any footage or other material that features or otherwise includes the Participants, the Winners and their Image(s);
c. to the fullest extent permitted by law, waive any moral rights or similar rights they may have in the Image(s) or any part thereof throughout the world; and
d. undertake not to object to any use of the Image(s) by THE CLUB or any party authorised by THE CLUB.
PERSONAL DATA
24. By entering the Competition, YOU expressly agree to THE CLUB’s Privacy Policy set out at the end of these Terms & Conditions. In addition, you consent to the sharing of your Data (as defined in THE CLUB’s Privacy Policy), for use by THE CLUB for the following purposes:
a. The use of your name for the purpose of identifying you as the author of your entry.
MISCELLANEOUS
25. THE CLUB reserves the right to modify the Image(s) as necessary, including but not limited to resizing, cropping or colour adjustment as necessary, while maintaining the integrity of the Image(s) and captions as originally created.
26. The Prizes are subject to variation at the discretion of THE CLUB, and any change will be final and binding upon every Participant in the Competition.
27. The Prizes will be given to the Winners as set out in these Terms & Conditions. The Winners must accept their Prizes in that form. The Prize is non-negotiable, non-transferrable, non-refundable and not exchangeable for in kind, either in part or in full except at the sole and absolute discretion of THE CLUB and is subject to the terms and conditions accompanying the Prize (if any). THE CLUB may at its sole and absolute discretion withdraw and/or substitute the Prizes with any other item of similar value without notice and without furnishing any reason.
28. All particulars submitted by each Participant shall be made with full and frank disclosure. Any misrepresentation may result in disqualification, forfeiture or withdrawal of any Prize won in THE CLUB’s sole discretion.
29. THE CLUB shall not be liable in any way for any failure or breach by any party in connection with the Competition, and/or the acceptance and/or use of the Prize, howsoever caused and accepts no responsibility for any loss suffered by a Participant arising from the Competition or the Prize.
30. THE CLUB will not be liable for the Prize if it does not reach the Winner for reasons beyond its control.
31. The Winners may be liable for any expenses not specified on the description of the Prize.
32. To the maximum extent permitted by applicable law, each and every Participant agrees to indemnify and keep indemnified, and hold harmless, THE CLUB, their respective officers, directors, employees, agents, distributors and affiliates from and against any and all claims, loss, damage or liability suffered and fees and costs incurred, including reasonable legal fees, resulting from any act, neglect or default or breach by the Participant or any person who may be authorised by the Participant, of any of the Terms & Conditions.
33. Each Participant, by entering the Competition, expressly releases THE CLUB from any claim, action or demand arising out of or in connection with the Competition, the Prize or these Terms & Conditions.
34. THE CLUB shall not assume any responsibility for the incorrect or inaccurate capture of Participant's information. This will include but is not limited to technical malfunctions, human or technical error, seeding or printing errors, lost/delayed/garbled data or transmissions, omission, interruption, deletion, defect or failures of: any telephone or computer line or network, computer equipment, software or any combination thereof.
35. If, for any reason, the Competition is not capable of running as planned, including but not limited to the reasons of infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of THE CLUB which corrupts or affects the administration security, fairness, integrity or proper conduct of the Competition, THE CLUB reserves the right to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Competition, all without question or need for communication to said party and without THE CLUB being liable to said party in any way.
GENERAL
36. By participating in this Competition, the Participant hereby agrees that he/she shall not, directly or indirectly, give, promise or offer and undertake not to give, promise or offer money, donations, gifts or other benefits whatsoever in order to influence with corrupt intent THE CLUB or any private person or business, or any employee or official of any government or government related establishment or public international authority, any political party (or candidate or official), or anyone acting on THE CLUB’s behalf, in the exercise of authority or in connection with obtaining any improper benefit or advantage with respect to this Competition or any matter covered by these Terms or otherwise take any action (or fail to take action when required) that would violate any applicable laws local laws and/or regulations.
37. Any provision of the Terms & Conditions that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of that prohibition or unenforceability. That does not affect the validity or enforceability of that provision in any other jurisdiction nor invalidate the remaining provisions of the Terms & Conditions.
38. The law applicable to the Terms & Conditions is the law of the Republic of Singapore and the courts of the Republic of Singapore will have exclusive jurisdiction in case of any dispute arising out of or in relation to the Competition.
39. In the event of any dispute arising or relating to the Competition, the Participant and THE CLUB agree to use best endeavours to first attempt resolve the dispute promptly and amicably, by good faith negotiation.
AMENDMENTS (BY THE CLUB)
40. THE CLUB reserves the right, in its sole and absolute discretion, to:
a. amend or alter any of the Terms & Conditions at any time without prior notice and by entering the Competition you agree to any such amended Terms. If THE CLUB amends or varies any term relating to the collection, retention, use and/or sharing of personal data that has already been collected, such amendments and/or variations will be posted on the Website; and
b. terminate or disqualify any Participant’s entry for the Competition or reclaim and/or disqualify any Prize(s) at any time if it is the sole opinion of THE CLUB that there has been a breach of any of the Terms & Conditions by such Participant (whether discovered during or after the end of the Competition).
PRIVACY POLICY
41. THE CLUB collects, uses and discloses only that information reasonably required to enable THE CLUB and its Third Party Suppliers for the photo competition, as described in THE CLUB’S Privacy Policy and is expressly incorporated into these Terms. By submitting any personal information to THE CLUB, YOU indicate your acceptance of THE CLUB’S Privacy Policy.
