The Stewards permitted Jockey V Sivan to replace Jockey WK Yan on TRAM PHAN TRAM as the latter was certified unwell.
Emergency acceptors, ROLLING KING and SMOOTH WINNER were withdrawn due to a capacity field.
Trainer P Lee was fined RM100/- under MRA Rule 65(5)(b) for failing to produce the declared colours on MAXI MARINE.
MAXI MARINE threw its head up on jumping, shifted out and brushed BIG DAWN.
BLESSWITHTALENT and TRAM PHAN TRAM were both slow to begin.
A post-race veterinary examination of BLESSWITHTALENT revealed no obvious abnormality.
The Club Veterinary Surgeon reported that WAI KOR returned having cast its off hind plate.
GENERAL REPORT(S)
RACE 1 (R1309), 1ST DAY, SATURDAY, 24TH OCTOBER 2009 CURRENT MEETING
A subsequent veterinary examination which was conducted on FOREIGN LADY this morning revealed that it was lame near fore and as such will be required to pass a test (1000M/vet) before being entered to race again.
AMENDMENT
AN INVESTIGATION INTO THE CIRCUMSTANCES SURROUNDING A STABLE INSPECTION WHICH WAS CONDUCTED ON TRAINER SB TANS STABLES ON FRIDAY, 16TH OCTOBER 2009 AT THE SELANGOR TURF CLUB
The Selangor Turf Club Stipendiary Stewards conducted a routine stable inspection on Trainer SB Tans stables on Friday, 16th October 2009. During the said inspection, some items used for the consumption of drugs and dangerous weapons were found in one of the Syces rooms located at Stable Block C6 of Trainer SB Tans stables. The said items were then surrendered to the police and a Syce was remanded on suspect of consuming drugs. An Investigation will be held on a date to be fixed.
INQUIRY INTO THE RUNNING AND HANDLING OF JERAM CORPORATE RIDDEN BY JOCKEY B STANLEY IN RACE 5 (R1274) ON SUNDAY, 11TH OCTOBER 2009 AT THE SELANGOR TURF CLUB OCTOBER MEETING 2009
On 23rd October 2009 at the Penang Turf Club, the Stewards concluded an Inquiry into the running and handling of JERAM CORPORATE. After taking evidence from Jockey B Stanley, the rider of JERAM CORPORATE, and Trainer F Maynard, and after reviewing the videos, Jockey B Stanley was found guilty of a charge under MRA Rule 44(8) in that whilst riding JERAM CORPORATE in Race 5 at the Selangor Turf Club on 11th October 2009, he failed to take all reasonable and permissible measures to ensure that JERAM CORPORATE was given full opportunity of winning or of obtaining the best possible placing.
The particulars of the charge were that:
1. After jumping away awkwardly, he failed to take up a forward position which was available to him in compliance with his riding instructions and instead relaxed his mount back, thereby losing ground on the leaders;
2. After suffering some interference approaching the 1000M, he unnecessarily shifted his mount outwards resulting in his horse losing its advantageous position on the rail and as a consequence, raced five wide without cover rounding the bend; and
3. From the 400M to the finish, he failed to give sufficient rein to his horse resulting in it throwing its head up on several occasions and did not ride his horse out with his normal vigour and determination.
When deciding on penalty, the Stewards took into consideration the facts of this case, Jockey B Stanleys record and his points of mitigation. After considering the provisions of MRA Rule 44(8)(a), Jockey B Stanley was disqualified for a period of one (1) year with immediate effect from 23rd October 2009 and to expire on 22nd October 2010, both days inclusive. In addition, he was fined the sum of RM50,000/- and was advised of his Right of Appeal (4:45pm).
In addition, Trainer F Maynard, the trainer of JERAM CORPORATE, was warned that in future, he would be expected to approach the Stewards should he have any concern or query with any jockeys ride on his horses.
Jockey B Stanley subsequently exercised his Right of Appeal on 24th October 2009 and applied for a Stay of Sentence, which after a hearing on 25th October 2009, was not granted. He was advised of his Right of Appeal against the Stipendiary Stewards decision not to grant him a Stay of Sentence (12pm).
At the conclusion of an Inquiry on 23rd October 2009 at the Penang Turf Club, Trainer F Maynard pleaded guilty to a charge of negligence under MRA Rule 152(5)(a) in that he failed to obtain a written approval for his overseas travel from the Committee or the Secretary of the Association at least 7 days prior to his departure for Australia from 12th to 16th October 2009 as required under MRA Rule 36(2). He was fined the sum of RM500/- and was advised of his Right of Appeal (5:15pm). He was further warned that a repetition may lead to a severe penalty being imposed.
