On Monday, 31 March 2008. Trainer C Leck was found guilty to the following charges under MRA Rule of Racing 134(5) in that:

(1) he was the Trainer and person responsible for presenting ARABIAN STAR to race in Race 4 at the Singapore Turf Club Meeting on Friday, 20 July 2007 following which a urine sample taken from the tenth placegetter, ARABIAN STAR, was found to contain the presence of metabolites of ACEPROMAZINE, a prohibited substance under the MRA Rules of Racing.

(2) he was the Trainer and person responsible for presenting KINGTRAP to race in Race 5 at the Singapore Turf Club Meeting on Friday, 20 July 2007 following which a urine sample taken from the eleventh placegetter, KINGTRAP, was found to contain the presence of metabolites of ACEPROMAZINE, a prohibited substance under the MRA Rules of Racing.

(3) he was the Trainer and person responsible for presenting JUSTOHELP to race in Race 7 at the Singapore Turf Club Meeting on Friday, 20 July 2007 following which a urine sample taken from the eleventh placegetter, JUSTOHELP, was found to contain the presence of metabolites of ACEPROMAZINE, a prohibited substance under the MRA Rules of Racing.


In terms of Rule 134(10), ARABIAN STAR, KINGTRAP and JUSTOHELP were disqualified from their respective races and the results amended accordingly.

After taking submissions from Trainer Leck and following advice in regards to police investigations, the Stipendiary Stewards adjourned to consider the penalty to be imposed on Trainer Leck.

On Tuesday, 8 April 2008, a former Syce of Trainer Leck was charged with three counts of Mischief in the Subordinate Court in that he, sometime in July 2007 committed acts of Mischief by using a syringe to inject a drug into the three horses. He pleaded guilty to the charges and the matter was adjourned until 15 April 2008.

Further Hearings on the case were conducted in the Subordinate Court on 15 April 2008, 29 April 2008, 6 May 2008, 20 May 2008, 27 May 2008 and 30 May 2008. The Deputy Public Prosecutor subsequently advised that an Appeal had been lodged with the High Court on 11 July 2008 against a ruling of the Subordinate Court to reject an application for a Dismissal Not Amounting to an Acquittal from the Deputy Public Prosecutor with regard to the Syce.

Hearings for this Appeal were heard in the High Court on 12 September 2008, 26 September 2008, and 17 October 2008.

A judgement was handed down in the High Court on 24 July 2009. In his judgement the Honorourable Judge allowed the Appeal and granted an application for a Dismissal Not Amounting to an Acquittal.

On 4 August 2009, the Stipendiary Stewards considered further submissions from Trainer Leck, after considering all the factors in regard to penalty Trainer Leck was disqualified for a period of 3 years on each charge. These penalties are to be served concurrently.

Trainer Leck subsequently exercised his right of Appeal on 4 August 2009 and was granted a stay of sentence.

Whilst the Stipendiary Stewards acknowledge it is regrettable that this case has taken so long to reach a resolution, this was largely due to the result of a number of ongoing issues including Police investigations and various Hearings in the Subordinate and High Courts.

SUNDAY, 02 AUGUST 2009:

RACE 1 [TF944]

At the conclusion of an Inquiry on Monday, 03 August 2009, Jockey R McMahon, the rider of MAGIC KEY, was found guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding MAGIC KEY in the first race at the Singapore Turf Club Meeting on Sunday, 02 August 2009, approaching the 1300m, he failed to make a sufficient effort to straighten his mount, thereby resulting in it shifting into the running of STRYKER (R Fradd), when insufficiently clear. This resulted in STRYKER making contact with GOLD HELP (App T Affandi) and having to check. When deciding on penalty, the Stewards took into account his record and the degree of interference and carelessness. Jockey McMahon was suspended from riding in races with immediate effect from Monday, 03 August 2009 to Friday, 21 August 2009 both dates inclusive (three Singapore Race Days) and was advised of his Right of Appeal.


RACE 10 [TF953]

At the conclusion of an Inquiry on Friday, 07 August 2009, Jockey D Beasley, the rider of ANY HUMOUR, was found guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding ANY HOMOUR in the tenth race at the Singapore Turf Club Meeting on Sunday, 02 August 2009, near the 200m, he made insufficient effort to straighten his mount, thereby shifting into the running of NTINI (J Moreira), when insufficient clear and carrying that gelding inwards, resulting in LIMS FIGHTER (KB Soo) having to check. When deciding on penalty, the Stewards took into account his record, degree of interference, carelessness and submissions from Jockey Beasley that he has been engaged to ride at the Singapore Race Meeting on Friday, 14 August 2009. The Stewards determined to suspend his licence to ride in races and acting under MRA Rule 48(5), the commencement of the suspension was deferred to begin on Saturday, 15 August 2009 until Friday, 28 August 2009 both dates inclusive (three Singapore Race Days). He was advised of his Right of Appeal.




RACE 12 [TF955]

At the conclusion of an Inquiry on Friday, 07 August 2009, Jockey R Fradd, the rider of NATTIER, was found guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding NATTIER in the twelfth race at the Singapore Turf Club Meeting on Sunday, 02 August 2009, near the 400m, he allowed his mount to shift inwards, when insufficiently clear, thereby crowding KILLA (R Stewart), which checked and lost ground. When deciding on penalty, the Stewards took into account his record and the degree of interference and carelessness. Jockey Fradd was suspended from riding in races with effect from Saturday, 08 August 2009 to Sunday, 23 August 2009 both dates inclusive (three Singapore Race Days) and was advised of his Right of Appeal.

FRIDAY, 31 JULY 2009:

RACE 4 [TF938]

At the conclusion of an Inquiry on Sunday, 02 August 2009, Jockey I Andy, the rider of AGGRESSIVE, was found guilty to a charge of careless riding under MRA Rule 44(9)(a)(ii) in that whilst riding AGGRESSIVE in the fourth race at the Singapore Turf Club Meeting on Friday, 31 July 2009, near the 800m, he allowed his mount to shift inwards, when insufficiently clear thereby crowding EL GREY (D Beasley) in onto GOLDEN JAMBHALA (D Chee), which checked and lost ground. When deciding on penalty, the Stewards took into account his record and the degree of interference and carelessness. Jockey Andy was suspended from riding in races with effect from Monday, 03 August 2009 to Sunday, 09 August 2009 both dates inclusive (three Race Days) and was advised of his Right of Appeal.
